The US is currently facing a healthcare crisis with millions of working-age citizens unable to work because of healthcare reform. As a direct result, these professionals are left without the financial resources necessary to properly care for themselves and their families. Without proper insurance coverage, these professionals are forced into working under conditions that are neither comfortable nor safe and are often underpaid for their hard work. For this reason, many professionals such as nurses, therapists, and doctors have either quit their jobs or have decided not to work at all. In order to protect their families, these same professionals are joining the ranks of the uninsured.
Unfortunately, it is not only professionals who have been affected by the US healthcare reform debate. As more Americans fall behind on the regular premiums required to maintain a certain level of healthcare coverage, they are being faced with the reality of having no health coverage at all. While many of the details of these cases are still unclear, the fact remains that many of the plaintiffs are suffering unnecessarily and are being treated unfairly. Many of the cases filed by these defendants are being challenged by healthcare providers as a violation of their constitutional rights. In order to protect its members, the American Medical Association has been forced to take action against some of the more outrageous lawsuits physician disability insurance.
One of the suits that has been causing quite a stir in the blogosphere recently involves a case involving a nurse who was denied coverage because she had a pre-existing condition. In her particular case, the plaintiff, identified as a Washington State resident, was denied coverage because she was diagnosed with multiple sclerosis. The nurse was later found dead in her home, apparently of natural causes. Her lawyer filed a lawsuit against her former employer, charging that the company discriminated against her on the basis of her disability.
Another lawsuit that has been generating quite a bit of buzz in the blogosphere concerns an individual who was fired from his job after he was found to have made anti-gay remarks in a private online forum. According to one of the plaintiff’s lawyers, the defendant went so far as to threaten the plaintiff with violence if he did not leave the country. Another case involved a nurse who was allegedly discriminated against while working for a Florida hospital. After filing a complaint, the plaintiff was fired and is now pursuing a case against the hospital, as well as the individual who claimed that discrimination occurred Wellness Blog.
It’s not all swell and dandy, however. Many of these cases have beenaucous. A particularly infamous case involved a former Miss Brazil who was allegedly discriminated against when seeking employment at a California casino. After filing a lawsuit, the court found in favor of the defendant, and the plaintiff was subsequently forced out of the state. There’s always room for improvement when it comes to healthcare professionals, but these situations do illustrate that there are many grey areas when it comes to disability insurance.
